Halal banking in Holland: legal framework, tax hurdles and real options

What Dutch law allows, what blocks home Murabaha, and what a saver can actually do today.

In the Netherlands, Islamic finance remains a niche: there is no specific framework, any banking business needs a standard licence from De Nederlandsche Bank, and the halal products available are mostly investments plus a few private initiatives.

No special regime in Dutch law

The Financial Supervision Act, the Wft, contains no chapter on Islamic contracts. An institution wishing to offer Murabaha or Ijara must fit into the existing categories of bank, mortgage lender or fund manager.

Two supervisors for one project

DNB checks prudential soundness and grants banking licences, while the AFM oversees conduct and the information given to customers. A promoter of halal products must therefore satisfy both authorities, in addition to its own Sharia board.

The EU passport as the easiest route

A bank licensed in another EU country can in principle serve Dutch customers under the European passport. This avoids a new licence, but a foreign institution must still follow Dutch consumer credit and mortgage lending rules.

Deposit guarantee versus Mudaraba

The Dutch scheme guarantees deposits up to 100,000 euros per customer per bank. A Mudaraba investment account, however, assumes the saver shares losses; a capital-guaranteed deposit contradicts this, so current accounts and investment accounts must be clearly separated.

Why home Murabaha runs into tax

In a Murabaha the bank buys the house and resells it to the customer at a mark-up paid in instalments. The Dutch tax authority treats this mark-up differently from interest, whereas mortgage interest relief weighs heavily in the real cost of buying a home.

Mortgage interest relief

A conventional borrower can deduct from taxable income the interest on a loan financing their main home, subject to repayment conditions. Without equivalent recognition of the mark-up, a Muslim household would pay more for the same home, making the product uncompetitive.

The 2008 tax refusal faced by Bilaa-Riba

Bilaa-Riba Islamic Finance, launched in 2006, spent over three years seeking acceptance that its mark-up was deductible. After a second refusal by the tax authority in 2008, the offer lost its appeal and the company stopped trading.

Transfer tax: the risk of paying twice

If the bank acquires the property and then transfers it to its customer, two successive transfers can trigger transfer tax twice and two notarial deeds. Without relief, this extra cost adds to the lost deduction and burdens any structure based on bank ownership.

Public debate about a market yet to be born

Dutch media regularly discuss halal mortgages, pointing to strong potential demand and failed attempts. The gradual reduction of mortgage interest relief has been described as a factor that could narrow the cost gap with Islamic financing.

Investing in shares and sukuk through a brokerage account

As local Islamic banking supply remains very thin, many savers use an online broker to buy Sharia-screened index funds or sukuk listed abroad. They should check the screening methodology and how non-compliant dividend income is purified.

Box 3: how halal savings are taxed

Personal investments fall under Box 3, taxed on a deemed return by asset category. A saver holding Islamic funds rather than a regular savings account is therefore taxed under the investment rules, not under any regime tied to halal status.

Insurance: no takaful operator

No licensed takaful operator is known on the Dutch market, and home or liability insurance remains conventional. Some Muslims turn to mutual or cooperative arrangements that resemble mutual aid, without being designed according to AAOIFI standards.
